Terms of Use

1. Introduction

These Terms of Use ("Terms") govern the access or use by you ("User") of the applications and services made available by Hiddouts ("we," "us," or "our"), a limited liability company registered in the Republic of Kenya. By creating an account, you agree to these Terms. If you do not agree, you must stop using the service immediately.

2. Age Requirement (Strict Liability)

The Services are intended strictly for individuals 18 years of age or older. By creating an account, you represent and warrant that you are at least 18 years old. Access by minors is strictly prohibited. If we discover an account belongs to a minor, we will terminate it immediately without refund.

3. Assumption of Risk & Duty of Care

Hiddouts is a technology platform that facilitates the storage and sharing of user-generated location data ("Hidden Gems"). We do not verify, inspect, or warrant the safety or legality of any location.

Physical Safety: You acknowledge that visiting locations found on Hiddouts involves inherent risks (e.g., terrain, weather, wildlife). You assume all responsibility for your physical safety.
Trespassing: You are responsible for verifying that a location is public property. Hiddouts disclaims all liability for trespassing violations or fines incurred.
Liability Release: Hiddouts is not liable for any injury, death, property damage, or legal penalties arising from your use of location data found on the platform.

4. Subscriptions & Share Groups

Hiddouts operates on a "Host-Pays" model.

Host Responsibility: The Creator (Host) of a Share Group is solely responsible for the subscription fees.
Loss of Access: If a Host fails to pay or cancels their subscription, all members of that Share Group will lose access to the group's shared content.
No Member Claims: Members acknowledge that their access is contingent on the Host's standing. Members have no claim against Hiddouts for loss of access due to a Host's default.
Refunds: Payments are non-refundable, except as strictly required by applicable consumer protection laws.

5. User Content & Conduct

You retain ownership of the photos and data you upload. By uploading content, you grant Hiddouts a license to display it within your private groups.

You agree not to upload content that is illegal, explicitly sexual, or promotes hate speech. We reserve the right to terminate accounts that violate this standard without prior notice.
